On November 2, 2021, the OAA and the
Ontario General Contractors Association (OGCA) published
Recommended Supplementary Conditions for the Stipulated Price Contract–CCDC 2-2020, for use with the 2020 edition of the Canadian Construction Documents Committee’s standard construction contract.
The OAA also created Practice Tip—
PT.23.11, CCDC 2-2020 Stipulated Price Contract Overview of the Changes in the 2020 Version and Recommended Supplementary Conditions for use in conjunction with the supplementary conditions. This new resource is not an exhaustive analysis of all the changes between the 2008 and 2020 versions, but highlights the significant content or procedural changes affecting the profession. Therefore, practices should familiarize themselves with CCDC 2-2020 and with PT.23.11.
The previous Practice Tip—
PT.23.1, CCDC 2-2008 Stipulated Price Contract Overview of the Changes in the 2008 Version and Recommended Supplementary Conditions—will remain available until the transition from CCDC 2-2008 is complete.
It is also important to remember the suggested wording in the OAA/OGCA Recommended Supplementary Conditions for the Stipulated Price Contract is not a substitute for involvement of legal counsel. Legal counsel should be aware of any court rulings that may affect the meaning of CCDC 2 and the recommended supplementary conditions. Your client should be advised to discuss the specific wording and requirements of all supplementary conditions with legal counsel.
